Sheen, 45, seeks joint physical and legal custody of their 1 1/2-year-old twin boys Bob and Max, while Mueller wants primary physical custody with visitation for Sheen, according to the papers filed in Los Angeles Superior Court, the People magazine reported.
Sheen and Mueller had separated on Christmas Day when they had a nasty fight in Aspen that landed the actor in jail.
The couple had tried to work on their marriage and both entered rehab. Sheen, who had attacked Mueller with aknife, was also placed on probation and sentenced to domestic violence counseling.
But the actor landed himself in soup again recently. He was hospitalised after he was found reportedly naked anddisoriented in a hotel room. Police sources say he was drunk but his representative said

Sheen and Mueller, who married in 2008, have a prenuptial agreement and according to the court papers Muellerwill will receive USD 55,000 a month in child support. She also gets a settlement of nearly USD 758,000.
The actor will get to keep the family's house, but he will pay Mueller around USD 1 million. He also will keep anearly USD 5.5 million watch collection, TMZ reported. Mueller is Sheen's third wife. He already has two daughters with ex-wife Denise Richards and was also married to Donna Peele in the mid-1990s. He also has a daughter with ex-girlfriend Paula Profit.
