The student community is not a different group which enjoys any extra right regarding freedom of speech and expression and the law does not grant protection if the right to protest is demonstrated violently, the Delhi High Court said.

Hearing petitions alleging police atrocities on students inside the Jamia Millia Islamia (JMI) University here following anti-CAA protests in December 2019, the Delhi High Court on Monday said excessive use of force cannot be justified.

A Delhi court judge, who recently discharged student activists Sharjeel Imam and Asif Iqbal Tanha, along with nine others in the 2019 Jamia Nagar violence case, has recused himself from hearing a similar matter, citing "personal reasons".

Jamia Millia Islamia postgraduate students staged a protest in front of the office of the university's proctor demanding that exams should be conducted online.

"Jamia has been closed for more than two years and students from all over the country have been demanding its reopening ever since the DDMA (Delhi Disaster Management Authority) guidelines to reopen all schools and colleges were released in the first week of February," the outfits said.

Delhi High Court asked Delhi Police to place before it the latest position of cases relating to incidents of violence in Jamia Millia Islamia University in December 2019 which had occurred in relation to student protests against the Citizenship Act.
